Terms of Service

These terms govern your use of IVY Shield (the “Application” or “Service”) at shield.ivysystem.co. The Service is provided by Noir Pixel Studio Iwona Bielecka, Palestyńska 1a, 03-321 Warsaw, Poland, VAT ID PL5242492216 (“we”, “us”, the “Application Developer”). By creating an account, subscribing or connecting a shop you agree to these terms and to our Privacy Policy.

1. What IVY Shield does

IVY Shield compares words and phrases — typed by you, or taken from the titles and tags of the active listings of a shop you connect — with public records of the United States Patent and Trademark Office (USPTO), and shows you possible matches with registered or applied-for trademarks. It can re-check connected shops automatically and send you email or webhook alerts.

2. Not legal advice

Results are generated automatically from public USPTO data and are preliminary information only. They are not legal advice, not a trademark clearance and not a guarantee that a phrase is safe or unsafe to use. The Service covers the US register only. For legal decisions, consult a qualified attorney.

3. Your account

• You sign in with a one-time link sent to your email address. Keep access to that mailbox secure.
• You must be at least 18 years old and use the Service for your business.
• You may connect only shops that you own or that you manage with the owner's permission.

4. Etsy and Shopify shops

When you connect an Etsy shop with “Connect with Etsy”, you authorise the Application through Etsy’s official sign-in to read your shop and its listings and to edit listing titles, tags and descriptions. The Application reads the titles, tags and descriptions of your active listings to scan them, and changes a listing only when you choose a replacement and click “Fix” — you see which listings will change before you confirm. It never creates or deletes listings and never accesses or changes prices, stock, orders, payments, buyers or messages. Shopify stores are read from their public product catalogue; if you add your own Shopify app for one-click fixes, the same rules apply. You can disconnect Etsy or remove a shop at any time in your panel; the access tokens and the shop’s data are then deleted.

The term 'Etsy' is a trademark of Etsy, Inc. This Application uses Etsy's API, but is not endorsed or certified by Etsy.

5. Plans, payment and cancellation

• IVY Shield is sold as a monthly or yearly subscription (Starter, Pro Shield, Studio & Agency). Prices are shown in EUR on the website and include VAT where applicable.
• New subscriptions include a 3-day free trial, once per person. A payment card is required at sign-up. If you cancel before the trial ends you are not charged; otherwise the first payment is taken when the trial ends and the subscription renews from then on. If we detect a repeated trial, the subscription starts as paid immediately.
• Payments are processed by Stripe. We do not see or store your card details.
• Subscriptions renew automatically until cancelled. You can cancel at any time in your panel (Billing); access continues until the end of the paid period.
• Each plan includes the limits described on the pricing page (shops, listings per shop, checks per month, scan frequency and features). We may apply fair-use limits to protect the Service.
• If you are a consumer in the EU, you agree that the Service starts immediately after purchase and acknowledge that you lose your 14-day withdrawal right once the Service has been provided.

6. Acceptable use

You may not misuse the Service, including by scraping it, reselling raw results as a database, attempting to access other users' data, overloading the Service or using it for unlawful purposes.

7. Availability and changes

We work to keep the Service available and the USPTO data current (it is synchronised with the USPTO's daily files), but we do not guarantee uninterrupted operation or that the data is complete. We may change or improve features; material changes to these terms will be announced by email or in the panel.

8. Liability

To the extent permitted by law, the Service is provided “as is”. We are not liable for listing removals, account suspensions, lost profits or other damages resulting from trademark claims, from reliance on results, or from missing data. Our total liability is limited to the amount you paid for the Service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

9. Termination

You may stop using the Service and delete your data at any time. We may suspend accounts that breach these terms.

10. Governing law and contact

These terms are governed by Polish law. Disputes will be handled by the competent courts in Warsaw, without prejudice to mandatory consumer protection rules of your country. Questions: ivysystemco@gmail.com.
